NOTICE IS HEREBY GIVEN THAT THE BOARD OF COMMISSIONERS OF THE TOWNSHIP OF LOWER SWATARA, DAUPHIN COUNTY, PENNSYLVANIA, INTENDS TO CONSIDER AT ITS REGULAR MEETING TO BE HELD ON WEDNESDAY, SEPTEMBER 19, 2018, BEGINNING AT 7:00 P.M. IN THE TOWNSHIP BUILDING LOCATED AT 1499 SPRING GARDEN DRIVE, MIDDLETOWN, PA, 17057, AN ORDINANCE, THE TITLE AND BRIEF DESCRIPTION OF WHICH IS AS FOLLOWS:

AN ORDINANCE OF THE BOARD OF COMMISSIONERS OF THE TOWNSHIP OF LOWER SWATARA , DAUPHIN COUNTY, PENNSYLVANIA, AMENDING THE CODE OF ORDINANCES OF THE TOWNSHIP OF LOWER SWATARA NO. 448, CHAPTER 5, CODE ENFORCEMENT, TO DELETE PART 2, BUILDING CODE, PART 3, FIRE PREVENTION CODE, PART 4, PLUMBING CODE, PART 5, ELECTRICAL CODE, DELETING PORTIONS OF PART 1, CODE ENFORCEMENT CODE, AND AMENDING PART 6, PROPERTY MAINTENANCE CODE, SECTION 5-606. GENERAL PROVISIONS. SUBSECTION 1. CONFLICTING PROVISIONS TO PROVIDE THAT THE INTERNATIONAL PROPERTY MAINTENANCE CODE 2009 EDITION TAKE PRECEDENCE OVER THE CODE ENFORCEMENT ORDINANCE [PART 1].
Section 1 of said Ordinance would amend Chapter 5, Code Enforcement to delete the Building Code, Fire Prevention Code, Plumbing Code, and Electrical Codes in their entirety. Subsection 4, Definitions and Subsection 5, Application to Existing Buildings and Building Service, Section 5-103. Enforcement Authority, Subsection 5, Fire Marshall, and Subsection 6, Assistant Fire Marshall, Section 5-104, Subsection 8, Subsection 9, Subsection 10, and Subsection 11 along with Subsections 5-105, 106, 107, 108, 109, 110, 111, 112, 113, 114, 115, 116, 117, and 118.
Section 2 of said Ordinance would amend the Property Maintenance Code, Section 5-606. General Provisions, Subsection 1, Conflicting Provisions, the last sentence thereof to read as follows: Where there is conflict between Administration, Chapter 1 of the “International Property Maintenance Code 2009 Edition” and the Code Enforcement Ordinances [Part 1] the International Property Maintenance Code 2009 Edition shall govern.
Section 3 of said proposed Ordinance would provide that all other Ordinances or parts of Ordinance in Conflict be repealed to the extent of any such conflict.
