Mom, aunt charged with providing heroin to 16-year-old daughter

The mother and aunt of a 16-year-old girl who overdosed on heroin have been charged with providing heroin to the victim over a course of four months in 2017, according to arrest papers filed by state police with District Judge David Judy.

The victim overdosed July 1 at her mother’s residence in Londonderry Township, after injecting heroin that was allegedly provided by her mother, Diane Lorraine Gutierrez, police said.

The victim was revived and taken to the hospital after being given multiple dosages of Narcan at the residence by emergency medical service personnel, police said.

Police allege that Gutierrez in March allowed her daughter to live with the victim’s aunt, Shauna Melva Rice, 38, at Rice’s residence in the 200 block of North Poplar Street in Elizabethtown.

From May to June, Rice allegedly brought the victim back to her mother’s house in Londonderry Township on a weekly basis so the victim could get heroin from Gutierrez, whom police allege also used heroin.

Gutierrez was arrested Sept. 22, arraigned before Judy, and charged with possession of a controlled substance, endangering the welfare of children, use/possession of drug paraphernalia, corruption of minors, and recklessly endangering another person. 

Gutierrez is in Dauphin County Prison on $75,000 bail. 

She waived her Oct. 5 preliminary hearing before Judy, sending all the charges to county court. She is to be arraigned in county court Jan. 5, 2018.

Rice was arraigned on Sept. 26 before night court District Judge George A. Zozos and charged with possession of a controlled substance, endangering the welfare of children, use/possession of drug paraphernalia, corruption of minors, and recklessly endangering another person.

Rice is being held in Dauphin County Prison on $35,000 bail. Her preliminary hearing before Judy is scheduled for Oct. 18.
